First, you should line yourself up a very good lawyer since this is illegal in all states if your husband is talking to a third-party and neither knows you are recording. In a one-party consent state like New York, you can record calls between you and your husband, but you cannot record anyone else who doesnt know this is going on. In a one-party consent state it is the same as taking notes.

So, unless the phone call is with you and both of you live in a one-party consent state, you are guaranteeing a very bad settlement and possible jail time. A mother who tried this against a schoolboard got a two-year sentence instead of the results she was looking for.
